Terms of Pocketpro.ee user agreement

By registering as a user on the website www.pocketpro.ee or the Pocketpro mobile application, you confirm that you have read the terms of this user agreement (hereinafter “Terms of Use”), agree to the Terms of Use, and undertake to comply with the Terms of Use in the following:

1. GENERAL PROVISIONS

1.1. These Terms of Use regulate the legal relations that arise when using the Internet platform www.pocketpro.ee and the Pocketpro mobile application between its owner OÜ PocketPro (registry code 16200184, location Kuu 28, Tartu 50104) and the User.

1.2. In the Terms of Use, the following definitions apply:

1.2.1. Pocketpro.ee – a virtual self-service platform located at the Internet address www.pocketpro.ee or Pocketpro mobile application belonging to OÜ PocketPro, which the User can use to publish information about their service, search for a service and obtain contacts of service providers, communicate with each other, and use other services offered by Pocketpro.ee.

1.2.2. User account – user ID and password of the person registered as a Pocketpro.ee user.

1.2.3. User – a person who has a Pocketpro.ee user account.

1.2.4. Tasker – a user who has added information about services provided by them to Pocketpro.ee.

1.2.5. Customer – a user who wants to find a service they need.

1.3. The functionalities and further developments of using the Pocketpro.ee platform are decided exclusively by OÜ PocketPro.

1.4. In addition to the Terms of Use, the legal relationship between the User and OÜ PocketPro is regulated by the laws in force in the Republic of Estonia, the principles of personal data processing, the price list for using the Pocketpro.ee platform and the established best practices.

2. CONTENT OF THE USER AGREEMENT

2.1. The content of the service provided by OÜ PocketPro is to grant the User the rights to use the virtual self-service platform Pocketpro.ee. The User is the data publisher in the Pocketpro.ee platform.

2.2. The User confirms that they are aware that Pocketpro.ee is a virtual self-service platform and that OÜ PocketPro does not provide a representative, broker, agent, etc. mediation service in the Pocketpro.ee platform and the User does not authorize OÜ PocketPro to provide such services. OÜ PocketPro does not provide the services offered by Taskers on behalf of the Taskers, instead the Tasker provides them directly to the Customer. The User also confirms that they are aware that all statements of intent submitted in the Pocketpro.ee platform are made by, and agreements are concluded between the Users and the Users are responsible for their proper performance. In their legal relationships, Taskers and Customers shall consider the provisions of the Law of Obligations Act, tax laws and other legislation.

2.3. The User confirms that they are aware that the Customer’s consumer rights depend on whether the Tasker is a person engaged in economic or professional activities or a private person. OÜ PocketPro does not exercise control over nor is in control of the terms and conditions of the Tasker’s services.

3. RIGHTS AND OBLIGATIONS OF OÜ POCKETPRO

3.1. OÜ PocketPro has the right to:

3.1.1. Check that the use of the platform is in accordance with the Terms of Use. Upon discovery of a violation, OÜ PocketPro may use all their rights provided by law and these Terms of Use.

3.1.2. Require the authentication of a person when creating a User Account and to process personal data under the conditions and pursuant to the procedure agreed in law and the Terms of Use and the principles of processing personal data.

3.1.3. Examine the materials made available to the public by the User at a suitable time to check whether the said materials do not contradict what has been agreed in the Terms of Use.

3.1.4. Charge the User for a fee for using the Pocketpro.ee platform according to the price list, see www.pocketpro.ee/hinnakiri/.

3.1.5. Unconditionally and immediately suspend the possibility to use the Pocketpro.ee platform (to block the User), if the User violates the law or the Terms of Use or there is a reasonable suspicion that the User might ignore them.

3.1.6. Charge the User for a fee for unblocking the User Account.

3.1.7. Remove published information from the Pocketpro.ee platform, if it conflicts with the Terms of Use or good morals or the law.

3.1.8. Delete documents added by the User to the Pocketpro.ee platform if they contain personal data.

3.1.9. Block the User's User Account, if the User violates the Terms of Use or the principles of personal data processing or established best practices.

3.1.10. Terminate the provision of Pocketpro.ee services without prior notice and to close the Pocketpro.ee platform.

3.2. OÜ PocketPro is obligated to:

3.2.1. Maintain and monitor the operation of the Pocketpro.ee platform and its availability to the User.

3.2.2. Ensure the operation of customer support to assist the User at the email address info@pocketpro.ee;

3.2.3. Block the User's Account based on the User's application after the User has duly fulfilled all obligations.

4. RESTRICTIONS ON THE USE OF THE PLATFORM

4.1. It is prohibited to use the Pocketpro.ee platform to commit or promote an act that is indecent, contrary to the legislation of the Republic of Estonia and good practices and customs, or otherwise inappropriate.

4.2. Including, but not limited to, the following acts are prohibited when using the Pocketpro.ee platform:

4.2.1. Creating access to resources on the Internet to which the User is not allowed access.

4.2.2. Using copyrighted works, trademarks, trade names, advertisements, licenses, industrial designs or other intellectual property, the use of which is not permitted by the User, or in a manner not permitted.

4.2.3. Unauthorized destruction, damage, or alteration of the integrity of data compiled or collected by means of computer technology.

4.2.4. Copying or transmitting data and materials in any way that places an abnormal load on the service servers.

4.2.5. Distributing in any way computer viruses or programs containing viruses or any other code, files, or programs and/or parts thereof designed to interfere with or limit the functionality of the telecommunications network, its equipment or the software used.

4.2.6. Promoting cruelty, physical or mental violence and illegal activities.

4.2.7. Referring, directly or indirectly, to other materials on the Internet, advertising the User himself or any other person or product, unless permitted by these Terms of Use.

4.2.8. Using the Pocketpro.ee platform to disturb the operation of the Internet network or other Users.

4.2.9. Entering incorrect data into the Pocketpro.ee platform.

4.2.10. Spreading false information on the Pocketpro.ee platform, insulting others in any way or other unworthy behavior.

4.3. It is not allowed to add documents that contain personal data (incl. name, personal identification code, contact information) to the Pocketpro.ee platform, as the added documents are publicly visible and searchable by search engines. Incorrectly added documents containing personal data must be removed by the User immediately. Pocketpro.ee may delete documents containing personal data from the Pocketpro.ee platform without notifying the User in advance.

5. USER RIGHTS AND OBLIGATIONS

5.1. The user undertakes to provide true personal data when registering as a Pocketpro.ee user, including registering under their correct and full name and using a valid email address and telephone number.

5.2. On the Pocketpro.ee platform, the User may disclose only such documents and information that are correct and that are not prohibited by law or the Terms of Use.

5.3. The User undertakes not to use the Pocketpro.ee platform for illegal transaction(s) and/or fraud(s).

5.4. The User undertakes to make sure and ensure that by using the Pocketpro.ee platform, the User does not infringe the copyright or other intellectual property rights of another User and/or a third party. In the event of a breach of this obligation, the User shall indemnify for the damage and other expenses caused thereby. When publishing a copyrighted work to the Pocketpro.ee platform, the User grants OÜ PocketPro the right to transmit the work published by the User in the Pocketpro.ee platform to third parties in any way, including reproducing, translating, editing, adapting, correcting, supplementing, adding to other works, collections, or databases. By publishing information or materials on the Pocketpro.ee platform, the User confirms that all rights related to the published information or materials belong to them or that they have received from the holder of the respective rights all necessary rights to publish data on the Pocketpro.ee platform. Ratings (feedback) available on the Pocketpro.ee platform may not be used without the prior consent of OÜ PocketPro.

5.5. By agreeing to the Terms of Use, the User grants OÜ PocketPro the right to publish the advertisement published by the User on the Pocketpro.ee platform and the ratings (feedback) given to them in other Internet environments to provide a better service. OÜ PocketPro has the right to decide at its own discretion the ranking of services in the search results.

5.6. The User undertakes to keep the password and username provided for the use of Pocketpro.ee in such a way that they do not fall into the hands of third parties and to immediately inform OÜ PocketPro by email if their password or username has fallen into the hands of third parties.

5.7. The User is obligated to pay for the use of the Pocketpro.ee platform in accordance with the established price list. The payment of the fee and its amount does not depend on whether Taskers and Customers enter into a contract or not.

5.8. The User undertakes not to submit claims against OÜ PocketPro, except for claims arising directly from the Terms of Use.

6. LIABILITY

6.1. OÜ PocketPro does not assume any liability in connection with possible damages to the User, especially in the following cases:

6.1.1. If the damage has occurred for reasons beyond the control of OÜ PocketPro, due to disturbances in the use of the Pocketpro.ee platform or in the Internet connection acting as a precondition for use or in a technical problem of the User's email service provider.

6.1.2. If the damage has occurred for reasons beyond the control of OÜ PocketPro because of a delay in the transmission or deletion of the User's information.

6.1.3. If the damage has occurred because of unauthorized persons’ access to the information on the Internet network or when such information has been changed by unauthorized persons.

6.1.4. If the User has claims regarding the availability of information, services or products submitted or received through or in connection with the Pocketpro.ee platform, their suitability for their purposes, their truthfulness and/or content.

6.1.5. If on the Pocketpro.ee platform, the User has published incorrect data (incl. about the User themselves) and/or documents or data and/or documents have been published for which the User does not have the right arising from law or the Terms of Use.

6.2. The User is responsible, among other things, independently and fully for:

6.2.1. The correctness of the content of the data and information submitted by them when using Pocketpro.ee and their compliance with the provisions of the Terms of Use and the law.

6.2.2. Abusing the objectives of use of the Pocketpro.ee platform.

6.2.3. Damages caused to the User and/or any third party in connection with violation of the law or these Terms of Use by the User.

6.2.4. Possible tax obligations arising from a legal relationship between the Tasker and the Customer.

7. PROCESSING OF PERSONAL DATA

The User consents to OÜ PocketPro for the processing of personal data in accordance with the laws in force in Estonia and the principles of personal data processing of OÜ PocketPro. By agreeing to the Terms of Use, the User confirms that they have read and agree with the principles of personal data processing.

8. VALIDITY AND MODIFICATION OF TERMS OF USE

8.1. The Terms of Use enter into force on the Pocketpro.ee platform as of the creation of the User Account and are valid indefinitely.

8.2. OÜ PocketPro has the right to change and/or modify the content of the services, parameters, restrictions, procedures, menu structures of the Pocketpro.ee platform, documentation, etc. without prior notice to the User. The changes are considered to have been notified to the User from the moment of their placement on the Pocketpro.ee platform.

8.3. OÜ PocketPro has the right to unilaterally change and supplement the Terms of Use and the price list due to the development of the services and in the interest of their better and safer use.

8.4. All messages and information are exchanged with the User in electronic form using the contact details provided by the User in the Terms of Use.

8.5. Amendments and supplements to the Terms of Use and the price list shall enter into force upon publication of the respective amendment or supplement on the Pocketpro.ee platform.

8.6. The User confirms their acceptance of the amendments and additions to the price list and/or Terms of Use in relation to the use of the Pocketpro.ee platform after the entry into force of the respective amendments/additions.

8.7. If the User does not agree with the amendment to the Terms of Use or to the price list, the User does not have the right to use the Pocketpro.ee platform or the use of the service is restricted.

9. FINAL PROVISIONS

9.1. The User and OÜ PocketPro try to resolve disputes arising from the use of Pocketpro.ee through negotiations. If the dispute is not resolved by negotiations, the dispute shall be resolved in Tartu County Court.

9.2. The Terms of Use are valid upon their acceptance by the User and are valid during the validity of the legal relations between the User and OÜ PocketPro regulated in the Terms of Use. The User has the right to cancel the Pocketpro.ee user agreement at any time by fulfilling valid obligations to OÜ PocketPro and other Users.

9.3. By agreeing to the Terms of Use and/or using the Pocketpro.ee platform, the User confirms that they have carefully read and understood the Terms of Use and agree that the Terms of Use are mandatory for them to follow. Upon acceptance of the Terms of Use, the terms and conditions become a binding agreement concluded between the User and OÜ PocketPro, which regulates the use of the Pocketpro.ee platform.
